What Happens When a Client Fails to Pay for Services Rendered, and What Are Your Rights?

Non-payment for services rendered occurs when a client or business partner fails to pay the amount due despite the proper performance of the agreed services. In such cases, the creditor has legal rights that allow them to claim payment of the outstanding debt, statutory late-payment interest, and, in certain circumstances, the costs associated with debt recovery. The fact that the services were duly performed provides a strong legal basis for demanding settlement of the outstanding receivable.

How Does a Formal Demand for Payment Work?

The first essential step in recovering an unpaid invoice is to send a formal demand for payment. This is an official letter requesting that the debtor settle the outstanding amount within a specified deadline, usually between seven and fourteen days. The document must include the details of both parties, the amount owed, the basis of the debt, and the payment deadline.

The formal demand plays a key role, as it is often the final step before legal proceedings and may be sufficient to prompt voluntary payment.

Can You Recover an Unpaid Debt Without Going to Court?

In some cases, it is possible to recover the outstanding amount without initiating court proceedings. An amicable settlement may be attempted, in particular through written exchanges or the establishment of a payment plan. This approach is often preferred where an ongoing commercial relationship exists between the parties. However, when the debtor refuses to pay or fails to respond, amicable efforts reach their limits and legal action becomes necessary.

How to Initiate Legal Proceedings to Obtain Payment?

When amicable attempts fail, the creditor may initiate legal proceedings. Several procedures are available, including the payment order procedure (injunction to pay) or standard civil proceedings. The choice depends on the amount of the claim and the available evidence, such as the contract, invoices, or correspondence between the parties. Once the court issues a decision, it serves as an enforceable title requiring the debtor to pay the debt.

What Happens Once You Win a Court Judgment?

After a favorable court decision, the creditor may claim not only the principal amount but also late payment interest and legal costs. If the debtor still fails to pay voluntarily, enforcement measures can be initiated through a bailiff, who may proceed with seizures of the debtor’s bank accounts or assets.

How Can You Avoid Unpaid Invoices in the Future?

To limit the risk of non-payment, it is recommended to secure contractual relationships from the outset. This includes drafting clear and detailed contracts, implementing advance payments or installment plans, and clearly defining payment deadlines. Proper documentation of the services provided is also a key element in the event of a future dispute.
